This Acceptable Use Policy ("AUP") describes the conduct expected of customers, end users, and anyone else who uses services provided by Troy City Internet Exchange, Inc. (doing business as "Meganet," "we," "our," or "us"). The AUP supplements the Terms of Service and is incorporated into them by reference. Violations may result in service suspension or termination, removal of offending content, and cooperation with law enforcement as required.
1. Purpose
The AUP protects Meganet’s network, our customers, and the broader internet community. It is intentionally broad so we can respond to threats and abuse as they evolve. Meganet, in its sole discretion, will determine whether a use violates this AUP.
2. Prohibited Uses
You may not use Meganet services to:
- Violate any law or regulation, including laws governing telecommunications, intellectual property, privacy, export controls, and tax.
- Infringe intellectual property rights, including unauthorized distribution of copyrighted material, trademark infringement, or trade-secret misappropriation.
- Distribute malware such as viruses, worms, ransomware, trojans, spyware, keystroke loggers, or any other malicious code.
- Attempt unauthorized access to any system, network, or account, including port scanning, vulnerability scanning without permission, brute-force attempts, or any form of network intrusion.
- Disrupt service, including denial-of-service attacks, network flooding, deliberate routing-protocol abuse, or any action that materially degrades service for other users.
- Forge or misrepresent identifiers, including spoofing IP addresses, headers, or originating phone numbers (caller ID spoofing) for the purpose of harassment, fraud, or evading law enforcement.
- Harass, threaten, or stalk any individual or group, including via email, voice, SMS, or any other transmission channel.
- Engage in fraud or deception, including phishing, pretexting, pyramid schemes, and any form of financial or identity fraud.
- Operate open relays or proxies that allow third parties to send mail, traffic, or attacks anonymously through your service.
- Resell or sublicense the service except as expressly permitted in your service agreement.
3. Network Security
You are responsible for the security of your own systems, devices, and customer-premises equipment. You may not take any action that compromises the integrity of Meganet’s network or its customers, including but not limited to:
- Probing, scanning, or testing the vulnerability of any system or network without prior written authorization from its owner.
- Circumventing user-authentication or security measures of any host, network, or account.
- Interfering with service to any user, host, or network (including mailbombing, flooding, deliberate routing attacks, and resource overload).
4. Bandwidth and Resource Use
Services are intended to be used within the parameters described in your order form or service-specific addendum. Sustained use that materially exceeds those parameters, or that interferes with other customers’ reasonable use of the network, may be addressed by Meganet through traffic shaping, contract review, or service plan adjustment. We will use reasonable efforts to notify you before taking action.
5. Email and Messaging
Use of Meganet email and voice services for unsolicited bulk messaging is prohibited. This includes:
- Spam: unsolicited commercial email sent in bulk.
- Address harvesting: collecting recipient addresses through scraping, social engineering, or list rental from non-consenting sources.
- List violations: failing to honor unsubscribe requests, failing to identify the sender, or otherwise violating CAN-SPAM, TCPA, or analogous laws.
- Robocalls and unsolicited SMS in violation of the Telephone Consumer Protection Act (TCPA), Telemarketing Sales Rule, or applicable state law.
6. Content Restrictions
You may not use Meganet services to host, transmit, or distribute:
- Child sexual abuse material (CSAM). Meganet has zero tolerance for CSAM and will report it to the National Center for Missing & Exploited Children (NCMEC) and law enforcement as required by 18 U.S.C. § 2258A.
- Content that incites violence, promotes terrorism, or facilitates illegal activity.
- Content that violates the privacy rights of others, including unauthorized disclosure of private personal information ("doxxing").
- Content that is defamatory, libelous, or knowingly false in a manner that causes harm.
7. Reporting Violations
To report a violation of this AUP, including abuse originating from a Meganet IP address, please contact us with as much detail as possible: timestamps (including time zone), source and destination IPs or phone numbers, message headers, and any other evidence that helps us investigate. Reports of CSAM should also be made directly to the NCMEC CyberTipline at report.cybertip.org.
8. Enforcement
Meganet may, in its sole discretion and without prior notice when warranted, take any of the following actions in response to a violation of this AUP:
- Remove or disable access to offending content.
- Block traffic associated with the violation.
- Suspend or terminate the service or account.
- Charge fees for reasonable costs incurred in responding to the violation.
- Pursue civil action and refer matters to law enforcement.
Where reasonable, Meganet will provide notice and an opportunity to cure non-emergency violations.
9. Cooperation with Law Enforcement
Meganet cooperates with law enforcement requests presented through proper legal process, including subpoenas, court orders, warrants, and emergency-disclosure requests permitted by 18 U.S.C. § 2702. CPNI is handled in accordance with FCC regulations as described in the Privacy Policy.
10. Changes to This Policy
Meganet may update this AUP from time to time. We will notify customers of material changes by updating the "Effective Date" above and, where appropriate, by email. Continued use of the services after the effective date of a change constitutes acceptance of the updated AUP.
